Ive tried that before and blocked traffic. There are cars parked
down there B Drive and you have to stop before that road or you
can't manouvere put safely as usually and on that side of the
road there are cars parked immediately after or you can't get
out.It doesn't work i've tried. Cars can get by not double deck
buses So confused wouldn't I be parked on the footpath of I
parked on the side of the DK? And obstructing traffic?
So it looks like my only defence is her disability, my own
arguments for parking, space and there beong an emergency. I
looked through similar cases but nothing specific to me. Will
look for some legislation and hope they drop me off

A couple of points, does your mother have a Blue Badge? If not
maybe suggest she should apply for one, that could help with
parking problems when you go to pick her up. The Blue Badge is
specific to a person, not a car.
Secondly, it is illegal to park on the pavement anywhere in
London except where specifically authorised. Would it be
possible for you to reverse into the driveway, it makes getting
back onto the road safer and your mother may find it easier to
get in the car if it's round the other way. Good luck with your
appeal.

Thanks yes she has a blue badge but family feud means I can't
access it. I can't reverse in because of the postiton of the
pole and the two stationary cars. I woule struggle reversing
from a main busy road (personally) and would be harder for me to
fit in. Thanks anyway

Hey all
Got an overwhelming no to my appeal. Do I now wait for them to
write with a new fine via NTO notice and hopes it times out or
just pay. I think when appealing I may have said I was tbe owner
but it is clearly a rental. Would that make any difference?

And this is what I sent them
I went to see my mum who has mobility issues and a blue badge
issued by Hounslow Council (HC) and my brother who is autistm
and had to park like this as I was due to take her out for the
weekend (I have evidence of bookings) but she she was feeling
unwell. She has has multiple health issues, gp and hospital
visits quite frequently. My mum lives at the adresss in
question, so I parked like this in an emergency. There was
space on the pavement for someone in a wheelchair or pushchair
to safely pass. The pavement is wide and much bigger than it
looks in the picture.
My brothers and sisters cars are there and they cannot move
anymore to give me space and they were not home anyway so they
were unable to to move their cars. What you cant see is a huge
telephone post in front of the drive so this is the only way for
me to park and reverse safely.
I needed to take my mum to the hospital and it takes her a
while to safely get in and out of the car. I had my brother with
me too and he has no independent road safety skills as he has
autism. The road I reverse into is very busy so need time to get
them both in safely and this is the only way.
The main road is narrow and buses and cars pass on either side,
and there are cars parked at the side of the road and they need
to stop to pass. I once parked sideways on the pavement on the
dropped kerb but it blocked traffic. In the picture taken there
is a car parked across the road so I would have blocked traffic
and this was my only option in an emergency There are cars
parked down there Benedict Drive and along hatton road, you have
to stop before that road or you can't manouvere out safely as
usually and on that side of the road there are cars parked
immediately after or you can't get out. Cars can get by if I
parked on the dropped kerb but not double deck buses which
frequent this road.
There is no pay and display and the other place to park across
the road had no space as that is my only other option.
I saw someone as I came out but was too late as I didn't realise
I was getting a ticket he had a hi vis jacket. The time I took
the picture was about 5 minutes or so after leaving the house.
He must have seen me and my mum coming out of the house but she
walls slowly with a stick and physical support from me, she
cannot go out alone independently.I took the picture about 5
minutes after my mum was in the car it was really hot so
couldn't leave her and chase the guy.
Can I ask for discretion to cancel this PCN as I tried to park
safely in the drive in the designated parking place and it was
a medical emergency.

OP, IMO you've spent more time canvassing opinion regarding
prospective parking options than dealing with the PCN.
Of course the authority said no. You did not have a statutory
defence, simply a range of mitigating arguments. You are only a
party to this matter until a Notice to Owner is served on the
registered keeper because liability rests with them. This could
be Enterprise or perhaps even a leasing company.
So we're likely at this stage of the process: 'Enterprise are
poor at dealing with NTOs which would heap confusion on the
whole process. You could play the game, but not without some
risk.'
Are you the hirer of the vehicle? If yes, then you are liable to
Enterprise contractually and prospectively financially.
Unless the PCN is paid then the registered keeper would be
served with a NTO. If you're the hirer, then you know your
contractual liabilities and Enterprise's options.
Can we get back to this PCN and Enterprise pl.

Enterprise won't 'serve' you with a notice, IMO the options are
that:
1. they might copy you in to correspondence addressed to the
council notifying them that you are authorised to act for
Enterprise, or
2. They make representations under the 'hire company'
grounds(which would give you statutory procedural grounds of
representation), or
3. They simply pay the penalty and recover this from you
contractually plus any admin. fees permitted.
IMO, your argument about not being able to park elsewhere goes
to mitigation only, it is not a statutory defence and would not
be considered by an adjudicator, should matters get that far.
IMO, the only positive action open to you at this stage is
extra-procedural i.e. notify Enterprise (what you tell them
about the events, I leave to you) and find out what their likely
response would be.
