PCN - PERTH ROAD (A) IG2 **Wrong App used for payment**
DIR By: ST_2023
Date: December 16, 2023, 10:18 am
---------------------------------------------------------
I received a penalty charge notice today for parking on Perth
Road (A) IG2. Initially, upon checking the road's signage, it
indicated parking location ID 7173. Using the "PayByPhone" app,
I made the payment without noticing the specific street name.
However, upon returning, I found a parking ticket issued by the
street parking enforcement office.
Upon further inspection, I realized that the payment made via
the "PayByPhone" app for parking location ID 7173 was intended
for West Berkshire Council, rather than the correct location in
Redbridge, which required the RingGO app.
The signage was ambiguous, failing to specify the necessity of
using the RingGO app for payment in Redbridge and as you can see
from pics is not very clear either. Consequently, despite
payment being made, I inadvertently used the wrong app,
potentially leading to discrepancies in the parking officer's
checks. Additionally, during this time, my companions and I were
dealing with an upset infant, prompting us to rush through
managing their needs.
I'm seeking insights and thoughts from experienced individuals
regarding this situation. The confusion with the apps and
unclear signage led to this issue, and I'm curious about
perspectives whether to fight this or let go and pay £40 within
15 days.

Unfortunately a mistake we have seen before. However, to make a
killer appeal, you need to know if there is nothing at all at
this bay that tells you which PbP app to use. The bay sign
seems to have something on it facing the footway; is that for
what app to use ? Also, I would have thought the app you did use
would have told you the street and location; does it ? It's
fatal to be in a rush when parking in London; London councils
must be dining out very generously on this sort of thing. At
the moment, I can't see a certain win at London Tribunals, sorry
to have to say it. Only thing that could swing it would be no
advice at the location as to which PbP app you must use.

I have looked across, no obvious signs to confirm which app to
use but just the parking location ID.

Obvious solution is a universal parking app that works for all
locations in the UK. However with the current supine government,
I don't suppose anything will happen. It's the same with road
user charging schemes, (mostly low emission zones), each one has
its own app; ridiculous !!

The 28 day wording on the PCN is wrong (I have 5 tribunal wins
on this).
I like to do all the correspondence when technical arguments are
involved so for my free help email mrmustard@zoho.com

Interesting point, curious to explore this avenue if there is a
defence that win me the case.

[member=7]mrmustard[/member] - I've sent you an email re: a very
similar PCN.

OK, unfortunately the 28 day point has now been accepted and
refused by adjudicators so it is an adjudicator lottery at the
tribunal.
Got your email. My desk is piled high with paperwork (am
managing 4 small credit jobs as well as 100 PCNs) so I may be a
day or two.

Massive thanks to [member=7]mrmustard[/member], Redbridge
Council has officially communicated to me, confirming they will
no longer contest the appeal. The case is now closed.
