       PCN recevied for parking on private land - Iceland Hornchurch

       Received PCN whilst the passenger were in the car. Please see

       Passenger being in the car is irrelevant. Need to see the
       signage, does it clearly state not parking within a bay is a
       breach of the Ts & Cs? This is Excel parking who make the rest
       of the industry look ethical and principled so don't expect an
       appeal to work. They are also  IPC (also known as International
       Parking Cowboys) member so a second stage appeal to IAS is also
       extremely likely to fail. Pay the invoice or strap in for the
       long haul and increasing threatening letters from debt
       collectors.

       There is no “period of parking” per

       --- Quote ---
       > 8(1)A notice which is to be relied on as a notice to keeper
       for the purposes of paragraph 6(1)(a) is given in accordance
       with this paragraph if the following requirements are met.

       > (a)specify the vehicle, the relevant land on which it was
       parked and the period of parking to which the notice relates;
       --- End Quote ---
       but any appeal based around this will be rejected anyway. You
       can appeal on this basis and then appeal to the IAS who will
       also reject it and then use as an appeal against a county court
       claim which may ultimately be discontinued.
       Search the forum for similar cases.
       Passengers remaining in the car is irrelevant, as @ixxy says.
       The car was still parked.

       The NtK is not PoFA compliant for a couple of reasons but, as
       others have already said, this non-compliance rarely works in
       the first two appeals.
       Firstly, if your were a genuine customer of Iceland then you
       should speak to the manager as they would have the power to get
       it cancelled - take the NtK with you so you can demonstrate the
       minimal (petty) contravention.
       Whilst you are there I would get some pictures of the signage
       (as already advised).
       I have examined the signage as best I can on GSV and I cannot
       see a specific clause regarding marked bays but I am examining a
       pretty blurry image so I cannot be 100% certain on that point.

       The manager at Iceland just fobbed by saying the land doesn't
       belong to them. Also, please find the signage there.

       The signage at the entrance clearly conveys the fact that this
       is Iceland property - go back and show the manager the picture
       of the signage and request that he cancel the PCN.

       Haven't received any reply so assuming that nothing can be done
       at the moment apart from ignoring their letters and following
       the same with the debt collectors.
