       Hi all. Driver entered a carpark and left after 15 minutes.
       Received a letter afterwards stating an overstay of the max time
       0 hours 0 minutes?! Advice is needed. Thanks in advance!

       ?
       On the back, I found it.
       It just looks like the driver parked for longer than the
       consideration period and didn’t pay. Or parked when the store
       was closed.
       What do the signs say? No parking after 8pm? Home Bargains,
       Leigh appears to close at 8pm on Thursdays and the time recorded
       in the car park is around 9pm.

       Took me a day or two to go back to the site. Here's the signage
       at the carpark. The driver was teaching somebody to drive and
       never actually parked up. I'm not sure if there's any leverage
       against this ticket but any help is appreciated

       To me, the non-parking argument looks like it has mileage based
       on the signage used.
       You didn't breach the contract because you did not park.
       Had the term stated, "No site access outside store hours", then
       the argument would be different.

       Does this look okay for an appeal to parking eye?
       Dear ParkingEye Appeals Team,
       I am appealing Parking Charge Notice [reference number].
       I deny that any parking contract was breached.
       The signage displayed at the site states "NO PARKING OUTSIDE OF
       THESE TIMES." The driver did not park the vehicle. The vehicle
       remained occupied throughout and was present only briefly while
       supervising a learner driver before leaving the site
       approximately 15 minutes later.
       The wording used on your signage refers specifically to
       "parking" rather than simply entering or remaining within the
       site. If ParkingEye intends the restriction to prohibit any
       vehicle from entering or remaining on the land outside the
       stated hours, then the signage fails to communicate this
       clearly.
       Under the Consumer Rights Act 2015, consumer contract terms and
       notices must be transparent and prominent. Where wording is
       capable of more than one meaning, the interpretation most
       favourable to the consumer should prevail.
       As drafted, the sign prohibits parking outside the stated hours.
       It does not clearly state that a driver who remains in an
       occupied vehicle for a short period without parking accepts
       liability for a £100 parking charge.
       If ParkingEye disagrees, please provide:
       the full wording of the contractual terms relied upon;
       evidence that the signage clearly communicates that merely
       entering or remaining on site outside operating hours creates
       contractual liability for £100;
       evidence that the signs were sufficiently prominent and
       illuminated at approximately 10 pm for those terms to be read
       before any contract could be formed.
       In light of the ambiguity in the signage and the fact that no
       parking took place, I request that this Parking Charge Notice be
       cancelled.
       Should you reject this appeal, please treat this as a request
       for the POPLA verification code together with copies of all
       evidence you intend to rely upon, including the site plan,
       photographs of all signs, and your contract with the landowner
       authorising enforcement.

       I would just make sure they know in no uncertain terms that you
       are appealing as the registered keeper and no inference can be
       sought otherwise.

       Here's the response I received from parking eye. It seems like
       instead of actually understanding my appeal they have just side
       stepped it instead. Any advice is appreciated
       Thank you for your appeal in relation to the Parking Charge
       incurred on 28 May 2026 at 22:13, at Home Bargains, Leigh car
       park.
       We have reviewed the details outlined in your appeal, peal, but
       we are not in receipt of sufficient evidence to confirm that the
       terms and conditions were not breached. The car park signage
       states that parking is not permitted during certain restricted
       hours, as specified on site.
       Our records confirm that the vehicle remained in the car park at
       a time when parking was not permitted.
       We are writing to advise you that your recent appeal has been
       unsuccessful and that you have now reached the end of our
       internal appeals procedure.
       If you wish to have your case independently assessed, please be
       advised, there is an independent appeals service (POPLA) which
       is available to motorists who have had an appeal rejected by a
       British Parking Association Approved Operator. Contact
       information and further information can be found enclosed. See
       also www.popla.co.uk
       Please note, if the Parking Charge was issued in
       Scotland/Northern Ireland, only the driver can appeal to POPLA
       (Parking on Private Land Appeals).
       As a gesture of goodwill, we have extended the discount period
       for a further 14 days from the date of this correspondence. If
       you appeal to POPLA, you will not be able to pay the discounted
       amount in settlement of the Parking Charge, and the full value
       of the charge will be outstanding. In addition, if your appeal
       to POPLA is unsuccessful, you will no longer be able to pay the
       discounted amount and the full value of the charge will be due.
