You should rebut everything they state in their response with
which you disagree, I haven’t read their response because it’s
horrible to read, but whatever points they make which are wrong
you should counter.
If they completely ignored your appeal and in particular its
four specific appeal points then you should restate these
concisely and state why they have not addressed them.
Don’t say anything about their replying to the wrong case, that
only gives them am excuse to send the proper response. If they
can’t get it right, they live with the consequences.

Comments on the Parking Operator's submission.
No real comments to make since the operator has made no attempt
whatsoever to rebut any of my appeal points.
Their response bears no relevance to my appeal.
It is not for POPLA Assessors to advocate on the parking
operators behalf - the operator must put forward their own
points of rebuttal along with their supporting evidence.
As POPLA Assessor Paul E Walker (Case ET6121/001) stated in a
recent assessment, " It’s for the parking operator to provide
evidence both to support its case and to answer any relevant
appeal grounds raised."
The Assessor correctly moves on to say, "I’m not satisfied the
information or evidence put forward by the parking operator is
sufficient to answer the appeal grounds raised."
This case is of similar circumstance - the operator has made no
attempt to address 'any relevant appeal grounds raised'.
This should therefore represent a successful appeal on my part.
I would also point out the following;
If the Assessor of this case decides to advocate on the parking
operator's behalf then the Assessor will be generating rebuttal
points and arguments which the operator has not put forward -
this will represent 'sua sponte' and therefore a mis-assessment.
Furthermore, an Assessor producing their own rebuttal points
will break POPLA protocol and leave the Appellant in a position
where it is too late to comment on the rebuttal points being put
forward - this will clearly be to the Appellant's determent.
My appeal remains completely valid - the operator's NtK does not
meet the requirements of meeting 'all the applicable conditions'
which Schedule 4 Paragraph 9(2) requires.
