Set Aside advice needed - UKPC Worthing Hospital CCJ
DIR By: Ignito27

---------------------------------------------------------
Hello,
I would appreciate some advice regarding a possible Set Aside
application.
A default CCJ was entered against me on 12 May 2026 following a
claim brought by UK Parking Control Ltd (represented by DCB
Legal).
The parking event took place at Worthing Hospital on 27 August
2025.
The allegation was:
"Not parked correctly within the markings of the bay or space."
This was not a non-payment case. I paid for parking on the day
and have now located bank statement entries showing payments
made at Worthing Hospital on the date of the alleged
contravention.
I was attending the hospital with my mother, who was undergoing
an investigation following a stroke. I also have NHS
correspondence confirming her treatment around that period.
In addition, I have photographs of the location showing ongoing
construction works and temporary traffic management around the
parking area.
Unfortunately, I did not file a defence before judgment was
entered.
My questions are:
Based on these facts, do I appear to have a realistic prospect
of success in a Set Aside application?
Would the evidence of paid parking, hospital attendance and site
conditions be considered a potentially valid defence?
Given that the judgment was entered on 12 May 2026 and I only
recently reviewed the full paperwork, would you recommend
pursuing Set Aside or paying the judgment before the one-month
deadline?
Thank you for any guidance.

Is Set Aside realistic?

Is this realistically worth pursuing as a Set Aside?
CCJ entered on 12 May 2026 (UKPC / DCB Legal).
The original parking charge was for allegedly not parking within
a marked bay at Worthing Hospital, not for non-payment.
I received the claim form but failed to file a defence in time.
I now have:
proof that I paid for parking that day,
photographs showing construction works and temporary traffic
management at the site,
NHS documents confirming the hospital visit.
Given those facts, do I appear to have a realistic prospect of
success with a Set Aside application, or am I likely throwing
good money after bad?
Honest opinions appreciated.

I will request threads be merged.
None of the three points you mention is a reason for not parking
in a marked bay, and the driver entered into a contract by
parking under which - presumably - the driver contracted to park
in a marked bay.

I agree with above.
You are attempting to defend your position with evidence which
is irrelevant to contrevention?

As above. You might have a realistic prospect of defending the
claim, but nothing you have told us so far would appear to
indicate a defence.
You also need to consider procedure here. Again from what you've
told us so far, it doesn't appear that any of the grounds for a
mandatory set aside under 13.2 of the Civil Procedure Rules
apply, so you'd be looking at the discretionary grounds under
13.3. A judge may want to know why the claim was not defended,
and also why it has taken over 4 weeks since judgement was
entered for you to apply to set aside the judgement.
