       PCN Havering Council- 52M Contravention code-Failing to comply
       with a prohibition on certain types of Vehicle

       Hello
       Just received these PCNs from HAVERING council for 52M
       Contravention code-Failing to comply with a prohibition on
       certain types of Vehicle. Surprisingly I have received 2 PCNs
       for the same alleged contravention at exactly same time. I have
       attached the PCNs copies with this. I went to pick up food and
       you can barely see the signs. I believe it was bus only routes
       (not bus lane) or so.

       So the venal and rapacious Havering Council carry on in the same
       old way.
       These are very well known restrictions on this forum, and there
       have been some wins at London Tribunals.
       1. PCN South St/Eastern Road
       Their photos do not show any signs being passed, because the
       signs are not at the location on the PCN. The signs are here at
       the junction of South Street and Atlanta Boulevard/ictoria Road:

       Note that this is an Oct 2024 view, the latest, so the signs may
       have been updated since. Havering were too idle and stupid to
       put the camera there instead of where it is now.
       2.PCN South St/Havana Close
       Their photos show you driving straight on on South Street, but
       you should have turned left into Havana Close
       Here is GSV, but its Dec 2020, and the sign has been changed to
       a "Flying Moorbike" sign.

       First point is that Havering will not re-offer the discount if
       you submit representations. That means if you do submit them, it
       means it becomes a total no-brainer to take them to London
       Tribunals, because the penalty remains the same, and there are
       no additional costs. But Havering do have costs, being the cost
       of preparing the evidence pack and also paying the adjudication
       fee.
       Looking at the two PCNs, I think the one for South Street/Havana
       Close would be harder to win at LT, because you are faced with
       the restriction sign, yet drove straight past it. For South
       Street/Eastern Road, you need to tell us your approach to the
       station underbridge. Was it a left or right turn, or just
       straight over the cross roads. There has been a win here, see
       Case Number 2240307021 in the LT Statutory Register for the
       Environment and Traffic Adjudicators.
       You might also care to look at Case Number 2250496292 which
       seems to match your circumstances entirely.
       So really it's all down to your attitude to risk; cough-up now
       for £80 or take the double-or-quits gamble at London Tribunals.

       It was straight cross over road and the signs were unclear. I
       will go and visit that place and take videos and pics. But this
       alleged contraventions, if you look at PCN- they have captured
       these at the same time. Not understanding how 2 contraventions
       were made at the same time.
       Thank you for kindly looking into it. I have to get back to them
       by 13th of June (Appeal). Already passed the 14days period.
