PCN - Parkingeye - Overstaying time

Hi all,
For this post I will refer to the driver of the vehicle as X.
X parked in Huyton Starbucks owned by EG garages on the
20/5/2026, ordered a drink and stayed in Starbucks for 2 hours
to do work. No employee informed X of the parking charges, and
that license plates had to be inputted at the front desk, even
though the shop and car park was empty, and X spoke to the
staff. X returned and the keeper of the vehicle received a £100
parkingeye fine on the 2/6/2026. This fine was on the outskirts
of Liverpool/widnes in an empty car park in a new EG service
station for overstaying in a Starbucks.
The time limit is 1hr30, x stayed for 2h17.
X also did the same at a later date yet has not yet received a
PCN.
What is the probability that X will get this overturned, or at
least one of the fines overturned if I get another one, or will
X have to pay both fines?

Curently the keeper of the vehicle is going to be pursued for
payment, unless the driver is nominated within 28 days, in which
case the driver will be pursued.
They are not fines. They are invoices for payment by the driver
under the contract the driver entered into by parking. If the
driver is not identified, Parking Eye will use the Protections
of Freedom Act 2012 to transfer the liability to the registered
keeper. Their PCNs are reasonably compliant although some have
argued against this.
The keeper could allow this to be taken to court, and argue the
case then. It’s unlikely that Parking Eye or POPLA will uphold
an appeal unless you can show that there was inadequate signage
at the location.

I think they've closed that loophole, their PCNs now invite the
keeper to pay the charge.
