       Waltham Forest – Code 31J Entering and stopping in a box

       Hi all,
       I would be grateful for any advice regarding this .
       Having reviewed the CCTV, the vehicle appears to have come to a
       stop within the yellow box for less than 2 seconds before
       traffic moved again. I appreciate that stopping in a box
       junction can constitute a contravention, but I was wondering
       whether such a brief stop might provide any grounds for
       challenge or whether there are any other arguments worth
       considering.
       The driver was my father. Since receiving this PCN he has been
       assessed by the mental health team due to concerns regarding
       possible dementia/cognitive decline, and he has now stopped
       driving altogether. I appreciate this may not affect whether the
       contravention occurred, but I mention it in case it is relevant
       to any request for discretion.
       Any thoughts, suggestions or help would be much appreciated.

       Is there any info on the PCN about viewing the video, (the sole
       evidence of the contravention) ? We need to see this to give
       good advice. I tried looking for it on the WF website but can't
       find it. Of course it's the usual useless website, of course !
       Found the video, which is available on the "challenge PCN" page.
       You are indeed correct the stop time was only 2 seconds, which
       for me is de minimis and they should give way on this, but
       won't, so you would have to take WF to London Tribunals with the
       full PCN penalty in play. However, you must first submit reps to
       WF, get them refused, and only then can you register an appeal
       at London Tribunals.
       I don't think mentioning your fathers mental health will help
       matters, but see what the others say. I assume it is your car,
       correct ?

       Thanks. I will try my luck  with the de minimis argument and
       father's mental health.
       The car is actually  in father's name.  I will challenge pcn in
       his name( he's happy for me to do this)

       You have no legal standing in terms of legal responsibility for
       the PCN. IN fact, you need to submit representations stating you
       are the sone, and thenand state the full facts about your
       father's dementia including copies of medical assessments. It it
       then more than likely they will give way. If they don't then
       take them to London Tribunals.
       Also wait for others to comment,  but don't miss the deadline on
       the PCN for submitting reps.

       Hi everyone  so i received  a letter on 7/ 7/26 requesting  an
       authorisation statement from my fathera  and then a day letter
       received  a  charge certificate!

       You left it too late to respond to the PCN which is dated 26th
       May. My last post was 6th June, and you only came back to us on
       11th July, beyond the 28 days you have to pay or respond to the
       PCN

       Crossed lines here.
       Taking their letter, signed by H. Ali, dated 7 July:
       ..'This document[authorisation statement] must be received
       within 14 days of the date of this letter, failing which the
       case will progress.'
       Then a CC dated 8 July.
       I would get the authorisation statement completed and send back
       to H. Ali  with a note to the effect...
       Thank you for your letter dated 7 July which I have at last got
       my father to sign(I raised his health issues in the
       representations and getting him to action matters is an
       unfortunate side effect) authorising me to act on his behalf in
       these matters. I hope you are now in a position to consider the
       representations sent to you earlier.
       I also enclose a copy of a Charge Certificate dated 8 July which
       I assume has been sent by mistake and ask that you take whatever
       action is necessary. Given that this was sent notwithstanding
       the council's undertaking not to do so suggests a slight left
       and right hand issue which I am sure you can resolve.
       I look forward to receiving your response to my dad's
       representations.
