       Sorry ignore the ask about ownership as it was another grounds
       for appeal but looks like it isn't relevant and I wasn't
       leasing.
       So guess just asking to select the correct contravention as it
       seems like moving. In that case my appeal may be automatically
       rejected given what the criteria is

       No.
       Step 1 - can they prove a contravention (their signage has been
       an issue in the past);
       Step 2 - who may be held liable.
       UNLESS they have supplied the council with ALL the evidence
       required under the Transfer of Ownership etc. regs, then the
       council MAY NOT transfer liability from Enterprise to you.

       Well I can prive that signage was not there at the time so the
       onus is on them to prove the date as that was put there after I
       drove there.
       Liability has been transfered to me after 6 months (out of time
       frame) but they still accepted and rejected my appeal when it
       wasn't. But as it doesn't state I assume I appeal under moving

       Sorry realised my original post made no sense
       MY PCN
       This does not state what it falls under but I assume it is for
       'moving'. The contravention on my PCN states:failure to
       comply..no entry for vehicles)
       TRIBUNAL CRITERIA
       Parking Contravention
       "did not occur .... no proper signage"
       OR
       Moving Contravention "
       (There was) "no failure to comply with a traffic sign"
       I guess this is me essentially saying I did comply with the
       traffic sign under the moving contravention when technically I
       didn't if I entered the road, I file under a moving
       contravention.
       But looks like to have wider scope I need to file under parking
       contravention to state that there was no proper signage. Even
       though by my deduction it is a moving contravention.
       Could I also state on the online and paper PCN there is no other
       mention of the type of contravention  (than what I mentioned
       above), so I selected the criteria (and wording) that fit the
       reasons I was trying to appeal. Or will they throw it out if I
       select parking?
       Hope that is clearer sorry for all my muddled thoughts.

       Sorry me again is it classed as served out of time if they
       reissued in my name after 28 days but originally served to me
       via enterprise. Where they said they wouldn't accept that appeal
       but eventually did. Hence the lovely letter they sent. Are they
       confusing me on purpose

       The issue is whether this was done LAWFULLY.
       First tell us whether the car was hired for less than 6 months
       (YES/NO) and then we can take it one step at a time.

       The contravention relates to moving traffic and is governed by
       the London Local Authorities and Transport for London Act, as
       stated on the Notice of Rejection. Can you repost this notice
       please because it is not clear and we need to see the photos of
       the dog's breakfast of signage (which is THEIR evidence in
       support of the rejection) far more clearly. In fact, as a local
       resident you could take additional shots.The signage would be a
       major focus in your defence under the grounds 'contravention did
       not occur'(it can't occur if it's not signed as required).
       Additionally, given Enterprise's track record IMO you should
       also appeal under the grounds of 'I was not the owner'. The
       adjudication decision I linked gives you chapter and verse on
       what Enterprise have to do in order for the council to cancel
       their liability. It's not optional as far as the council is
       concerned: if the registered keeper does not provide everything
       needed under the Road Traffic (Owner Liability) Regulations 2000
       then the RK remains liable.
       There's also a collateral challenge as regards the NOR and what
       payment is due and when. As worded, IMO it's contradictory and
       unclear.

       Thanks for your reply. I forgot to say the adjudication link is
       broken. New pictures won't matter now as it seems like they
       added different signage after this happened in Jan 26. This was
       not there when I drove down.

       The photos they submit in evidence MUST show what was there on
       the day. This is why we need to know what dates are embedded
       within the letter.
       It is worthwhile taking photos even if the signage has changed.
       After all, why should they change what they claimed was
       perfectly adequate!
       Pl take some photos and also post whatever time info is in the
       photos in their notice.
