It appears that it was issued outside of the necessary period.
It look as if they are not using POFA hoping the RK will pay. I
am sure the necessary advice will be provided in any event not
to name driver and they can make a decision. I received one due
to wife in similar circumstances and it was pursued

You must appeal as the Registered Keeper stating that you will
not be naming the driver and no inference can be made who was
driving. They have not complied with requirements of POFA and
that in itself may be enough to lay the matter to rest.

Yes, Smart today appears to have two different templates for its
notices, one which states that PoFA 2012 provisions apply and
one which doesn’t. This appears to be one of the latter.
