Essentially, this was a motorcycle parked in a place where, a
few years previously, the rider had been advised by members of
staff at the car-park. Many motorcycles would park in that area,
and it is close to where the cycle parking is.
This has been the case for years, and so the rider assumed
naturally that not only was it legitimate to park a motorcycle
there, but that it was actually the preferred location.
If UKPC decided to change this policy it should have been
clearly indicated.
As it is, in this car park, there is no maximum stay time, but
car drivers take a ticket, and pay before exit, with it being
free if they exit within 90 minutes.
Motorcycles do not take a ticket and leave through a route
between some bollards, with the gates actually having a "no
motorcycles" sign.
Therefore, the agreement in general on the signs does not apply
to motorcycles with regards to tickets either.
In the "bicycles.jpg" image, the yellow on the floor (which is
actually red brick) denotes the place the motorcycle was parked
on this occasion. It is noted that no motorcycles are parked
there in the image, presumably because they have been handing
out charge notices to them.
Note that the parking charge was sent by post "notice to keeper"
but nothing attached to the vehicle at the time. The parking
charge date is 28/04/2026 but the date of sending was
06/05/2026.
The day after the parking charge was given: so is that 7 May or
29 April? It is not clear, as it says Parking charge date:
28/04/2026, and the date 06/05/2026 is in much smaller writing
near the top.

Some extra points from AI:
I have gathered more evidence from the UKPC portal and my own
vehicle tracker
Predatory Timing / No Consideration Period:
My tracking device shows I arrived at 14:00:00. UKPC's own
evidence photos show they began photographing at 14:01:31 and
finished at 14:01:56. This is a total observation time of only
25 seconds. I contend this is a flagrant breach of the mandatory
Consideration Period (BPA Code Section 13), as it is impossible
to secure a motorcycle and read terms in that timeframe.
PoFA Failure (Period of Parking):
The Notice to Keeper provides only a single timestamp (14:02)
and no "Time From/To" observation period. Given the photos only
span 25 seconds, I believe they have failed to specify a "period
of parking" as strictly required by PoFA 2012 Sch 4 Para
9(2)(a).
Obscured/Inadequate Signage: The sign photographed by the warden
is not up close; it is located behind a shopping trolley bay and
was obscured by trolleys. I am not even certain it was the
closest sign to the vehicle.
Implied Permission / Custom and Practice:
Motorcycles have used this specific "patch" near the bike racks
for years without enforcement. Furthermore, on a previous
occasion, I was verbally instructed by a member of site staff to
park in this specific area rather than in a regular car
bay.Notice to Keeper: No ticket was left on the vehicle; the NtK
arrived via post.
Does the 25-second observation combined with the lack of a
stated "period of parking" on the NtK make this a
high-probability win for a PoFA non-compliance argument?
