There are two grounds on which you can argue against this.
1. That the notice to hirer you have now received does not
comply with PoFA 2012

because
the required notices were not served at the same time as the
Notice To Hirer.
2. This is not “relevant land” for the purposes of PoFA 2012.
In either case, you should not identify the driver.
Show us the notice rather than just saying it’s “identical”,
please. The detail is important.

Perhaps a point of style rather than substance, but I'd swap 1
and 2 round.
In cases that do not take place on "relevant land", Schedule 4
of the Protection of Freedoms Act does not apply at all. I'd
lead with this point. The other point can be made as an "Even if
this was relevant land, which it isn't, they still wouldn't be
able to hold the keeper liable" style point.
It might look at bit confusing to open by disputing compliance
with legislation that in theory does not apply to this case.

VCS don't rely on PoFA with these 'Charging Notices' - instead
they use the assumption that the keeper (or hirer) was the
driver.
They'll keep pestering the hirer but will generally lose if it
ever gets to court.

Thank you everyone, that is very helpful.
Here's the upload of the revised invoice. If there's any more
advice that I should consider, I would appreciate it, otherwise
I will review all the notes and focus on drafting my fist
response in the next few days.
