       You’ve obscured the dates on the N1SDT form, so we can not
       advise directly, but you have 14+5 days from the date on the
       form to submit a defence or Acknowledgement of Service, and if
       the latter you have an additional 14 days to submit a defence.
       What you posted above covers the main point, that the registered
       keeper can’t be liable and the driver has not been identified
       because of Smart’s inability to comply with the requirements of
       PoFA 2012.

       Ah sorry, the form was dated 28th May. So is there anything to
       change or should I just reply this on the online portal? Thanks

       File defence or AoS by 16 June.
       If AoS is filed, the deadline for filing the defence becomes 30
       June.
       I would be happy with what you’ve proposed, but it does not harm
       to wait a while in case others have better ideas.

       This is very likely to result in a discontinuation by DCB Legal,
       but not before you have attended a mandatory mediation session
       (offer £0) and block attempts by DCB Legal to call you or email
       you to “settle”. In due course your case will be allocated to
       your local court (you will file a N180 form when required to
       specify this) and dates by which the claimant has to pay the
       court fee will be defined.
       Search the forum for Smart and DCB Legal to review many similar
       cases. Smart failed to issue its notices in time in the past, as
       in your case.

       Update: DCB Legal sent across their Directions questionnaire but
       I have had a look on my MCOL account and can't see anything
       indicating that I should prepare mine yet. Is this normal? I am
       a bit worried about this defaulting if I miss a deadline.
       Also, does it harm me to ask DCB Legal what their settlement
       offer would be? I would like to know out of interest in the rare
       case it relatively cheap (less than £70), just to save me a bit
       of time and stress.

       Our experience is that they very often discontinue, so if you
       stick it out, there's a very strong chance you'll pay nothing.
       But if you're set on trying to settle, why let them set the
       agenda? Both sides can make offers.

       Yes, it's normal. Once MCOL says it's been sent you can complete
       the N180 online and you will find advice on its completion if
       you search the forum.
