I'm not a parking expert, so I'll leave it to others more
knowledgeable than me to advise you, but is the problem that you
were returning from a shopping trip with your client?
My reading of the T&Cs of your permit is that it only gives you
unrestricted parking if you are visiting your client in their
home and that it can't be used to support your client while they
are shopping: "... The permit must not be used for patient or
client-related matters, for example, picking up prescriptions or
shopping on behalf of your client to take their home address,
nor parking whilst taking them out to appointments or for
respite hours away from the home, for example, taking to a park
or beach or out shopping..."

I presume that means you can't use it for parking while your
client is shopping, but whether it also means that you can't use
it for parking when you return your client to their home, I
don't know. For future reference I suggest you ask your
employer's permit account manager whether such use is permitted.
I don't know whether this might affect
[member=12]Incandescent[/member]'s suggestion re an informal
challenge and its wording
[Edit: looking at the time on your permit and the time of issue
of the PCN I assume the enforcement officers might have seen you
returning and knew it wasn't strictly a home visit...?]

ManxTom: I read it as the pass cannot be used to park up to
shop, but in OPs case they have returned with the service user
and are likely going to go inside with them to prepare food/etc
then the pass is being used to support them in their own home.
Obviously the council may have different views, and then I dare
say that the council may have the final say as it's quite wishy
washy on their site!

OK thanks for replies, what is vrm? I also want to point out
cant remember if did before, the traffic wardern clearly said to
me on camera I had 3 minutes, when it is clearly 5 minutes, I
know this is prob no good in court. I would still like to add he
also showed know consideration for the person I was supporting
who has special needs. I will now look to see photos, one other
thing, does the yellow lines not being fully complete still
stand or is that long gone now as the ones I was parked on are
very bad and have some tar mac on bits of it covering the lines.
Ive even noticed today, they stsarted to re fill the surrounding
areas but not the street I was parked on? I will look at online
pics now.

These are the pics on there site, one has me in on has the SU,
obviously ive had to hide us from the pics.Im not even sure
legally if the SU is allowed to be on a site like that as I know
just to have pictures we have to speak to the office in everyday
situations.

VRM means vehicle registration mark - ie your numberplate.
There's no need to cover this up, it's on display to the public
all the time.
To me this looks fairly straightforward, if you were "parked
outside their patient/client’s home address" then your pass is
valid. You should write a fairly simple challenge and include
proof that you were parked outside the patient/client’s home
address, and the Council ought to cancel the PCN.
Complaining about the Warden is also possible, but it should be
a completely separate process to appealing the PCN and would
best be done once you've got the PCN cancelled. Mixing the two
processes up is likely to confuse matters.

From the council's website:
Where you can park
Whilst displaying a care and health worker permit, you may use
your permit to park for free and for as long as your client’s or
patient’s scheduled visit lasts (up to three hours) when:
parked on street in areas of limited waiting
parked on street in resident permit holder bays
using on street pay and display spaces (but not car parks)
using any combination of the above
You may also use it to park for up to three hours on most single
or double yellow lines if all the parking spaces on the street
are taken, or none exist near your client’s address.
From this it would seem that the burden lies with you here i.e.
to convince the authority that when you parked 'all the parking
spaces on the street are taken, or none exist near your client’s
address'.
As the PCN was issued so soon after you parked, any adjudicator
would take the photos of the surrounding area as representing
the situation when you parked.
EDIT - IMO, you should think about what the CEO saw when they
issued the PCN i.e. they saw the car in a road context. They
knew nothing about shopping or whatever, so I wouldn't even go
there. IMO, they MUST presume legitimate use if the permit is
displayed correctly. But whether legitimate use = no
contravention depends upon the prevailing circumstances which
are whether 'if all the parking spaces on the street are taken,
or none exist near your client’s address'. Of these, only the
use of the road would be evident to the CEO.
I can't see your photos so, do any show free parking spaces in
the vicinity of your car. IMO, even in this respect, 'vicinity'
is subjective and as the client's incapacity would not be known
to the CEO, then either there were free spaces very near or, IMO
more likely, the CEO did not understand the use of your permit!
In which case, IMO don't go beyond the basic and obvious in
informal reps.

Hi
Strange thing has happened I cant seem to login, I was at work
last night and only had my phone, ive now tried at home and im
getting the same message
When I type in my details I get this
The Penalty Charge Notice could not be found.
Please check that you have not mistyped.
Can someone else tripple check if it works or not

Would they have cancelled ? Ive taken screenshots but wierd I
cant login. The SU I was with ive seen since, funninly enough
there is a traffic warden who works for my company, he told the
SU the traffic warden was new, could they have spoken to each
other and cancelled? Im a bit concerned now as obviously this is
the cut off point or maybe its tomorrow? What does served mean
do you get a few days so pcn was 1/4/26 its the 13/4/26 today,
14 days is the 15/4/26.
Let me know waht you think, I can add screenshots if needed but
ive tried to login now for 2 days and cant seem to?

Your PCN has Devon County Council at the top, so why did you try
looking on North Devon Council's website ? Their photos show the
PCN served, plus your pass.
