Avon and Somerset NIP Speeding in temporary 50mph speed limit on
motorway

Hello
I received a NIP for travelling at 57mph in a temporary 50mph
speed restriction on the motorway.
The purported offence took place on 06/03/26. However I only
received the NIP on 24/03/26, which I have evidence of as the
letter can be seen in the postmans hand on my door camera.
Do I have an grounds for the letter being outside of the 14 days
of issue?

Are you the registered keeper of the car, and does the V5C have
your correct address details on it?

Are you the Registered Keeper of the vehicle (i.e. do you hold
the V5C). and are your details on it completely correct? Also,
what is the “docref” date shown (foot of page 2, I think)?
If none of that provides a reason for the late service of the
NIP, you will have to decline any out of court offer the police
may make (of a course or fixed penalty) and plead not guilty in
court.
There the police will only have to prove the date of posting
(probably the date of issue, 11th March) and it is presumed
served on you two working days later (13th March). Your job will
be to convince the court (on the balance of probabilities) that
it was delivered after 20th March.
The cost of failure is high. If convicted you will receive a
fine of half a week’s net income, a surcharge of 40% of that
fine and costs of around £650.
Whatever you do about the speeding offence, you must respond to
the “request for driver’s details” within the 28 days allowed.
Failure to do so will see you commit a more serious offence
which carries six points.

Yes the name and address is correct.
I cant see any docref date on any page.
It was my wife driving at the time.

What document are you looking for the docfef, you should be
looking on your V5C.

How long has the car been registered in your name at your
current address, then?
That said, with an offence date of 6/3 (a Friday) and the notice
produced the following Tuesday, it seems unlikely the police had
any problems with your address. If that is the case, the choice
you have is as I explained in my earlier post.

Is the envelope containing the NIP clearly identifiable on the
images from your door camera?

For the avoidance of doubt, the date we are looking for is the
date after the DocRef. No. at the bottom of page 2 of your V5C
(current design V5Cs) It does not actually say "DocRef Date", it
says "DocRef. No. " followed by the DocRef. No., followed by 3
pairs of digits, in the form DD MM YY (which is clearly a date
code). If your V5C is the older style, it might be elsewhere,
but generally trivial to find (assuming that you have the V5C
because you are the Registered Keeper).
