Bus Stop Fine

Hi
Last May I stopped for ten seconds in a bus stop to drop my Dad
off at Gidea Park Stn so he could get the train to visit my Mum
in hospital. I had my 5yo son in the car with me. I received a
fine (I think £70) and appealed it, hoping they would cut me
some slack given the circumstances.
Four months later I received a letter saying the fine had
increased from £140 to £210 as I hadn’t replied to the original
letter. I called Havering council and they said I had to email,
so I did that and got an auto reply saying they were busy and
would be in touch, don’t contact us again. A further three
months and I received another letter so emailed again, with the
same response. Now they are threatening bailiffs and
repossession, yet won’t answer emails or the phone. I am willing
to pay the original fine, surely they can’t keep increasing it
without responding to any of my correspondence?

Sorry, but we need some hard data to look at your case. Havering
are a notoriously venal and rapacious council, with an appalling
administrative organisation, so your story doesn't surprise me.

predicament. However, one question - is the name and address on
your V5C Registration Certificate for the vehicle up-to-date in
all details

The car was registered in my ex girlfriends name, and she has
since sold it

The good news is that you are in time to get the process reset.
With the Order for Recovery comes a form which (if submitted in
time) gives you the right to have the process revert back to
before the Charge Certificate was issued on the basis that you
submitted representations to the council but never got their
notice of rejection.
Others will be along with more detailed instructions (I've got
no personal experience of this bit).

Assuming your bus lane PCN was served under the Transport
Management Act 2004, you should have received a Form TE9 Witness
Statement included in the envelope containing the Order for
Recovery. Please tell us if you received this form. If not, you
can download it from the TEC website: -

TEC seem to not know that this form covers PCNs served under the
Traffic Management Act 2004 !! One would think a government body
which is part of the Ministry of Justice would know, but there
you are.

/ Charging Authority, or their enforcement agents, to confirm
this information. We cannot help you with this.
• You wish to pay / arrange a payment plan - contact the issuing
authority OR the Enforcement agents not TEC. We cannot help you
with this.
If you’re emailing to obtain forms, you can download these forms
from

• this is the preferred option and removes delays that you may
experience in your email being handled.
*Please don’t send chase up emails, we are working in arrears
and this will add to the current volumes.
*If you have submitted an out of time application, please note

Was the original notice sent to you or your gf? If it's her hame
then she will have to deal with it. You can deal with it if she
gives you permission to do so.
If the council have sent an information pack, does it have a
photo of a little yellow sign at the bus stop that says "No
Stopping Except Buses"? That gives the car driver a clue as to
not what to do and there's usually an associated camera watching
you. If that photo is missing or the sign isn't there, that can
be a good point of appeal.
