Parkingeye PCN - Overstay - Home Bargains Wey Retail Park,

Similar to the post made by [member=1404]petrolhead48[/member] ,
another gym user has incurred a similar parking fine for
overstay on Sunday attendance to PureGym, located within Wey
Retail Park, Byfleer, this time not in the morning but Sunday
evening after 4:30pm.
The PCN has been received for not registering parking as a gym
user on the 15th February 2026, issued 20th Feb, 2026.
They have never needed to validate the registration plate in the
gym as parking has always been free, as per the gym staff's
instructions.
The PureGym app shows their gym activity history, and concurs
that they were in the gym between the times shown on the PCN.
The alleged contravention is that they overstayed the carpark's
max time limit of 0 hours and 0 minutes, which is because it's
suggested to be an 'out of hours' time on the weekend.
Signage is provided on this post too, though Sunday times are in
small print.
The gym is also unstaffed on Weekends, not giving gym users much
indication other than a notice board in the gym that emphasises
post-10pm logging of parking registration.
Any advise on challenging such a PCN is welcomed for other gym
users as it is unclear from [member=1404]petrolhead48[/member]
's forum how exactly the challenge they raised, was overturned.

Post up the PCN redacting only personal info.
First thing to note is that you can only defend the stated
contravention - so no need to worry about the non-registration
at the gym for the moment.
Route One is always an approach to the Gym management - you may
need to be forceful and suggest that you may terminate
membership - client acquisition costs are high in this sector
so hopefully they won't want to lose you.
A picture of the sign may also help us.

Notwithstanding the other salient points in your post, I fear
the OP may have chosen the wrong time of year to expect clemency
from a gym.
I do business analytics and have many gym chains as my
clients.........without exception, January and February are
where they gain 90% of their new members for the entire year,
all locked into nice 12 month contracts which 80% of them have
abandoned by mid-March.
They won't even blink at the threat of a single member
cancelling their membership.

Fair comment.
All I can say is that the Route One approach has always been a
very successful approach at these places.
I cannot say I have looked at results month on month but I take
the point re Jan + Feb.
Don't under estimate social media review sites either -
obviously give the business a proper chance to sort the matter
first.

So, the Parking Eye NtK is not PoFA compliant so they cannot
transfer liability from the unknown driver to the known keeper.
The signage is also ambiguous in nature.

As posted in the original thread:
In the end I didn't need to challenge the PCN through
ParkingEye. Instead I emailed info.byfleet@puregym.com and spoke
to the manager of the gym. I explained it wasn't made clear the
parking conditions had changed, I provided the details of the
PCN and they followed it up with ParkingEye on my behalf. A few
days later I received the letter to say it has been cancelled.

Parkingeye won't agree it's not POFA compliant and it's unlikely
POPLA will either.
Signage looks fairly clear to me, gym members need to register
outside store opening hours, I'm assuming the store in question
is Home Bargains but the sign quite clearly lists when the 3
hours free stay is applicable.
Best bet is to follow petrolhead48's approach and if the doesn't
work appeal on the grounds the driver was a gym user, that might
get it cancelled. Appeal based on the PCN not being POFA
compliant and claiming the signage is ambiguous will almost
definitely get rejected. If appealing on the grounds the driver
was a gym member you've at least got a slim chance of it being
cancelled.

The signage, in BIG letters, states 'No parking outside of store
hours'.
Then at a later stage, in small letters, states that gym members
can actually park.
For me the PE NtK is clearly non-compliant and I believe that we
can articulate this to POPLA.
However, Route One remains the most effective method in the
early stages.
