       In the criminal sphere, the crisis is not new either. Criminal
       policies have been more important than the frank interpretation
       of the law throughout the history of socialist
       institutionalization. Abominations have been conceived as the «
       pre-criminal danger index », fortunately abrogated in the new
       Criminal Procedure Law, or "prioritized crimes" (not recognized
       in the law but present in the daily life of criminal law
       operators in Cuba). A crime that is considered prioritized must
       be judged differently from that indicated by law, its
       consequences transcend the moment of the investigation and its
       possible conviction because it goes as far as the prohibition of
       the penal benefits that a sanctioned person deserves.

       too the administrative controls have been immense. Judges are
       inspected for their acquittals, prosecutors for not upholding
       the request for a high sanctioning framework for the accused,
       The 2019 Constitution maintained the rule, already existing in
       the 1976 Constitution, that the courts receive directives from
       the Council of State. With this, the influence of the Communist
       Party in the administration of justice is rounded off, because
       in Cuba the Party directs the State and the entire society.

       Accordingly, the principle, also constitutional, of the
       independence of judges is in question. This practice could be
       seen in the video , recently broadcast by Diario de Cuba, from a
       meeting held in 2018 between leaders of the Supreme Court, the
       Attorney General's Office and the Ministry of the Interior. In
       it, the president of the Supreme Court declares out loud that
       the administration of justice is agreed between the different
       bodies involved in the criminal process and makes it clear how
       the People's Courts help the Prosecutor's Office to fix their
       files and provisional accusatory conclusions in order to to
       categorically punish the accused.
