Interesting article, and we have all seen quite a bit of
"corrupt government working for itself" these days. I guess new
York State was right when they said it's time to abolish these
unneeded layers of "public management" when they gave Village
citizens the ability & tools to "vote their Village out of
existence". All v8llage TAXPAYERS are footing the bill for the
attorneys & courts to fight this crap out to some resolution.
Sadly Government = Corruption these days, so More Governments,
like Villages only equal MORE Corruption.
This little bit from that article says it all, the Village of
FAIRPORT wants that property badly, badly enough to break the
law...
The nearly 400,000-square-foot mixed-used building, constructed
more than a century ago, is one of several properties in the
village owned by entities associated with Douglas Calabrese.
Calabrese, meanwhile, has his own case against the village
underway in U.S. District Court in the Western District of New
York. That complaint alleges village code enforcement officer
Mark Lenzi and village manager Bryan White have engaged in
“selective enforcement, retaliation and harassment since
approximately 2019.”
Calabrese, NCTBP Calabresse LLC and American Park Place, LLC,
are plaintiffs in the federal case, which was initially filed in
state Supreme Court on Oct. 21 and then transferred to U.S.
District Court on Oct. 28.
Calabrese alleges that the village of Fairport has previously:
• Blocked public access to his property at 10 Liftbridge Lane by
converting a public roadway into public outdoor seating and
restrooms, thereby diminishing the building’s value;
• Attempted to block public access to his building at 53 N. Main
St. after he refused to sell the property to the village. That
attempt failed, his complaint states, because the planned
actions also would have interfered with the CSX railway entry
point.
• Condemned the building at 80 N. Main St., despite an
independent engineering inspection that determined the property
was structurally sound. That action, the complaint alleges, cost
Calabrese more than $280,000 in lost rental income from a
prospective cannabis tenant.
• Denied a request by Calabrese to have a neutral code
enforcement officer from Penfield conduct the inspection of 111
Parce Ave., and then obtained a warrant that Calabrese contends
was unconstitutional and in retaliation because he exercised his
rights for an impartial inspection.
