Who will get sued if and when the Perinton Dam fails?

At first glance, it would seem that the dam owners are
responsible for the losses if our dams were to fail.
These days, that would be a huge payout for the NYPA.
But wait! Aren't they the people who are telling everyone their
newly acquired dam is unsafe?
Aren't they saying they want to fix it and make it safe?
Aren't they telling everyone all the problems they have, thanks
to the previous owners and politicians who totally neglected the
maintenance and repair of this structure?
Seems they have a few roadblocks, from local politicians and
others.
There's this thing called CONSTRUCTIVE NOTICE.

We believe the NYPA could claim they have adequately given
Constructive Notice that they want to repair their dams, and
they have warned everyone there was a risk of failure etc.
Wouldn't this relieve them of liability, and place the onus on
those blocking them from carrying out this work?

Maybe a better question is this:
Who will file the lawsuits on behalf of those unfortunate ones,
who lost their lives in the Perinton Dam Flood, a flood that
could have been avoided if the 2018 Canal Embankment maintenance
work was allowed to proceed in Perinton, instead of being halted
for the protection of "shade" by a lawsuit brought against this
public safety work?
It would appear that no matter how hard the NYS Canal
Corporation & parent firm, NYPA, try to protect the public "from
themselves", they will be met with what some call "well-meaning
community spirit".
And that resistance will say "No to Safety" in the name of some
other cause... like shade, or the environment, or save the
trees.
Too bad this time they chose the bad guys in Embankment Safety
to rally for... TREES are the PROBLEM to PUBLIC SAFETY in
Perinton right now.
Specifically the TREES covering an Embankment Dam right in the
middle of Perinton that is 65' tall, a mile long and Rated a
High Hazard to all

I stand corrected once again by Google Maps...
The Perinton Dam #8 is 1.3 miles long and about 65' above the
surrounding area to the west, it's located at the Oxbow Lake

This is only one of EIGHT Embankment Dams located within the
Town of Perinton along the Erie Canal.
Do you know where the other SEVEN Perinton Dams are?
More importantly, do you know where to evacuate to, if one of
these EIGHT dams were to burst?

For those doubters, who think Perinton doesn't have "any" Canal
Embankment Dams, two maps that show the "danger" that some Town
& Village residents want to simply "ignore", hiding behind a
social media group who has only denied the issues in their own
community and misrepresented the facts about embankments along
the Erie Canal
Here are where the first FIVE dams in Perinton are located

Here are where dams 6 through 8 are located in Perinton

And here's the Town by Town count of Earthen Embankments in
Monroe County alone:
Town of Sweden 13 Canal Embankment Dams (status -
Cleared/Maintained)
Town of Ogden 11 Canal Embankment Dams (status -
Uncleared/ not Maintained)
Gates/Greece 3 Canal Embankment Dams (status -
Uncleared/ not Maintained)
Brighton/Henrietta 2 Canal Embankment Dams (status -
Uncleared/ not Maintained)
Town of Pittsford 4 Canal Embankment Dams (status -
Uncleared/ not Maintained)
Town of Perinton 8 Canal Embankment Dams (status -
Uncleared/ not Maintained)
That's right, 41 High Hazard Earthen EMBANKMENTS in a distance
of less than 32 miles along the Erie Canal, with more than 2/3
of them still NOT properly cleared, or maintained well enough,
to allow proper safety inspections for the past 75 years.
And social media still wants to deny & ignore that simple fact
