It's really sad for all involved that the firm representing them
seems at best out of its depth and at worst guilty of multiple
ethical breaches in an attempt to boost the size of the claim.
It's important that the facts are properly examined - but it's
also right that the.rugny authorities defend the claims as well
as they can and holding the plaintiffs to an appropriate
standard of evidence is part of that.

The firm was set up by Boardman specifically for this claim.
Particularly after his failed attempt to sue Will Green for
getting a second opinion you have to wonder who, if anyone, is
advising the other claimants and how many may actually have a
case.

What are the financial implications of this litigation? Are the
RFU (us) going to be bankrupted?

The chances of the claim succeeding are below 50%, the duty of
care that the organisations being sued hold is likely to be very
narrow, and the fact that the claimants have willingly
participated in a contact sport is also significant.
The benefits of rugby against the injuries would also play a
part in any judgement, that is of course all dependent on
linking the injuries to the playing rugby and then looking at
the scientific knowledge at the time the injury took place and
attributing blame to defendants.
The similar NFL claim was settled with no admission of blame or
liability outside of court.
Even based on current medical and scientific knowledge it is
difficult to attribute the injuries to rugby in the balance of
probabilities, as they also happen to those who never play
contact sports.
