Rfu have written to sarries confirming he's eligible for their
game v Bristol, so that counts towards his ban. So presumably if
any of our players get selected they will be released back for
the game v Irish. Surely...

Released back? Yes. Able to play? No.
Anybody in England camp can be released back to their club at
any time (just ask Adam Radwan). Technically, I guess Farrell is
released back to Sarries but then banned from playing that game.
If a Quins player who had been selected for a 6N team were to be
banned from tomorrow, the same rules would apply.

Not really - IMO they just being practical.
If not, all Borthwick had to do was release Farrell back to
Sarries for an afternoon so he can sit on the crowd and watch
Sarries v Bristol. Something he may do anyway.

Yeah, this is some tabloid journalism. The RFU confirmed that
the match Farrell could have been released for despite being in
the England squad is a match he could've been released for
despite being in the England squad.

I know that the England coach could have released Farrell for
the game in question, but we all know that players who are due
to feature in the match day squad never get released back to
their club to play. Members of the wider squad often get
released back to their clubs and do play, but you never see a
player in the 23 play for their club the weekend before an
international. So, while the RFU are perfectly entitled to do
this, and would probably do it for any other player that the
national coach wanted to select, it is still pretty cynical and
does undermine the disciplinary process to an extent.
I don't think it is Sarries bias, as I think they'd do the same
for any key player, but they are in theory saying that Farrell
could have played in that game, when we know that any other
players who end up playing vs Scotland will not be playing for
their clubs the weekend before.

So was Nick David ever going to play the BaaBaas one night and
then a Prem Cup game the next? I'd argue that the isn't a
chance.
Which leads to the question as to how disciplinary committees
are supposed to decide which games players are missing. At the
moment, they opt for a very black and white approach. If the
player is eligible to be selected for a game, it counts. That
does lead to some gaming of the system but is a clear approach.
Farrell is eligible to be selected and will be until the England
team v Scotland is picked.
If we start asking disciplinary committees to second guess which
games players would have played in (but for the ban), we can tie
ourselves in knots.
International players rarely play in Prem Cup games. Should
those matches be part of a ban? Some players don't like playing
on 4G pitches and are usually rested for those games. Does that
count? Ugo hated travelling outside the M25 so would a Newcastle
game have counted in any ban for him?
