Thuggish behaviour in your eyes but not in the eyes of the
disciplinary panel. Again your comments say a lot about you.

At the bottom of the graphic posted on the first page of this
particular thread, it says:-
"Foul play resulting in head/neck contact results in minimum of
mid range entry"
As it was deemed unintentional then the hope of any appeal might
rest on whether the person was injured or not, as the other
options are probably ruled out - perhaps TT could offer some
help here.
Also, the "details in judgement" comment under mitigation may
also contain relevant observations (such as he was being held
illegally).

By the time the panel sits, they have usually spoken with
everyone involved as well as medical staff, etc. It would seem
strange to say that Taylor was injured without checking first.
Tom Dunn's case is now on the RFU site
(www.englandrugby.com/governance/discipline/disciplinary-decisions)
so I'd imagine that Brown's will be this afternoon.

It's probably fair to say that the determination of where the
starting point in a given case is will draw from a number of
factors including things such as:
Force/weight in the impact
Type of impact (swinging arm v foot v trailing arm in a tackle
etc)
Relative positions of the two players (were they both upright/in
a tackle/both on the floor etc).
I would guess that a contact between foot & head on a prone
player is going to be judged as more serious than someone who
gets a red card for accidental contact with the head during a
tackle, so that would incline the panel to consider the starting
point should be higher than mid range.
As for the comparison between Mike's incident and Andre's,
Andre's first red card for the elbow to the head had both
players on the ground at the start & an uncovered body part
(elbow) going into the face of the Gloucs player as he (Andre)
was rising, so the force would be a lot less than that which
Taylor would've been subject to on Sunday, where a large part of
Brown's weight would've been applied through studs onto Taylor's
head. The potential injuries (something that will have an affect
on the starting point decision) would have been far worse in
Brown's case than in Esterhuizen's.

Treading on someone's face can be accidental but caused by
reckless behaviour. In the same way that reckless driving can
cause you to crash, but you didn't deliberately crash.

Yes - but standing up from a ruck isn't reckless behavior -
that's the point, reckless driving requires you to be doing
something like driving over the speed limit or driving whilst
impaired - driving in itself is not a reckless task.
So BB - what about MB's actions was reckless? Or are you still
not getting it?
