Affidavit sworn to on May 28th, 1901 by Henry Berbenich
Berbenich in the 1901 New York City Directory and a photograph
of the building he lived in in 1901 which still exists at 2708
Broadway several miles north of the Lower East Side in the Upper
West Side.

A couple of items.....
It is perhaps not surprising that when news of Damon's story was
first brought out, they all came out of the woodwork since what
the coterie of press reporters ( Riis, Butler, Coleman, etc.)
had to offer up to now was only hearsay). Even Jacob Riis, if he
was at all involved in the 1900 pardon effort due to his
relationship with Roosevelt which he might not want to tarnish,
wouldn't have influenced Gov. Roosevelt even if he had sworn an
affidavit earlier. Coming forward in unison might have a
different effect on the Governor now that news of Damon's story
had reached the ears of a few people but had not yet been
published in the newspapers.
What would be the purpose for Berbenich, who obviously was up to
speed on the 1901 pardon campaign, to concoct this story? His
reluctance in coming forward earlier wouldn't have fazed any of
the Governors so that probably explains him being a non-entity
in the story up to now.
One the one hand, he states that the blood found in Ali's room
was there, which validates the police position on blood in Room
33, but that it may have entirely been found there as a result
of an unscrupulous pressman.
Berbenich is actually doing at least three things with his
affidavit to my thinking :
1. Validating the fact that blood was where the police said it
was found all along.
2. That it is possible that one of the reporters, unbeknownst to
Riis, Butler, and Coleman, to name three but excluding them to
be clear, had tried to create a sensation that really needed no
outside assistance. The murder was automatically connected to
the Whitechapel Murders. This could explain the blood being
where it was found but yet was not seen by any of the 'blood
doubters' as it may have been planted there when none of them
had been on the fifth floor. This is just a suggestion.
3. If Berbenich felt that Ali was guilty, the odds would be on
him not coming forward at all. He seems to have a sense of honor
by his coming out. Just an opinion.
One of the three bigger problems in the case along with Damon
and the Press was Coroner Schultze. His piss poor handling of
the crime scene ( He wasn't much better in the Carlyle Harris
case)
may have allowed the inadvertent contact with blood by headline
hunters when they shouldn't have even been allowed in the murder
room.
