The verdict in the "Frenchy" case is in the nature of a
compromise. The chain of circumstantial evidence against him was
exceedingly strong, and resisted all the assaults made upon it
in behalf of the accused. His own testimony was confused and
contradictory, and did nothing to help his case. The natural
reluctance of twelve men to condemn a fellow-being to death on
circumstantial evidence doubtless was a large factor in bringing
about a verdict of murder in the second degree, which carries
with it a sentence of life imprisonment. The presumption that
the Algerian was guilty of a deliberate and most atrocious
murder was strong indeed; but in the absence of clear and
positive proof connecting him with the crime the jury are not to
be blamed for rendering a milder verdict than would seem to have
been called for
