Fitzgerald was the assistant bartender. He came to court in a
new suit of clothes, and Lawyer House wanted to know where he
had got it. The witness said that the District Attorney had
given it to him. That was a lead that tickled Mr. House, and he
tried to get Fitzgerald to admit that he had received money
also. Fitzgerald said he had had $2.60 since May 1, when he was
first sent to the House of Detention. He got that from Mary
Miniter. On his direct examination, he said that he first saw
Frenchy two days before the murder.
"I object to the witness characterizing the death as a murder,"
       said Mr. House.
"Well, we will call it the night Shakespeare died," said the
       Recorder.
