       No.  The issue is, or at least should be, has the player
       fulfilled the requirements of a certain number of days on the 40
       man roster, or does he hot.  Mind reading has no place in
       contract performance, regardless of the business.

       Megill looks like a totally different pitcher this spring.  If
       he had no options left (I assume he does) he would be a lock to
       make the team.

       Dave-The Bryant grievance was all about intent/motive. Basic
       contract law starts with a covenant of good faith. This goes
       back to centuries old English common law. Here is the basic
       statement taught in law school (usually in the first week of a
       class on Contracts):
       “In every contract or agreement there is an implied promise of
       good faith and fair dealing. This implied promise means that
       each party will not do anything to unfairly interfere with the
       right of any other party to receive the benefits of the
       contract. Good faith means honesty of purpose without any
       intention to mislead or to take unfair advantage of another.
       Generally speaking, it means being faithful to one’s duty or
       obligation.”
       Obviously, the concept of “good faith” or “intention” (to
       mislead or not) has what you call a “mind reading” element. Why
       someone did or is doing some act or course of conduct is central
       to many, many components of the law. It is a cornerstone of much
       of our jurisprudence in virtually every field.

       I'm not sure I'm seeing much correlation between hitting up
       around 100 and being very good! Norwood, Maples, Stock...  Maybe
       an inverse relationship?

       Yeah, Norwood labored the entire inning (which he couldn’t
       finish).
       Shelby Miller was clocked 93-95 but I only saw one good
       off-speed pitch. Will have to be better than this to make the
       club.
