Irrespective of whether you think Heimlich deserves a chance
after what he did (and we still don't know exactly what he did
do), and more importantly, whatever the Cubs think about that,
there's zero chance they draft him. When you consider a player
like that you consider the distractions that go along with him,
and Theo has no appetite for that sort of thing.

Exactly. It's why we didn't go after Chapman last year.

Seriously, I've been thinking. Those records are sealed, but if
it became the norm for them to be revealed, what would we do if
we discovered that guys like Trout or Rizzo or Kershaw had
something like that in their juvenile folders or any kind of
       offense deemed disgusting.

I really don't want to know. Don't want to know their
peccadillos, their politics, their family problems. Happy for
Rizzo and his charity, Ross and his dancing, and sad about Santo
and his physical ailments, but tell me less about off-the-field
       stuff--the better.
Will always feel a form of kinship with the guys who brought us
a World Championship but the other stuff is too scary sometimes.

MLB is an association with member clubs. MLB has a Constitution,
agreed to by the member clubs, that goes back to at least 1921.
It gives the Commissioner broad authority. See link below. At
Sec. 3(d), the constitution confers on the Commissioner
authority to take punitive action including "temporary or
permanent ineligibility of a player." So, MLB absolutely has a
stake regarding this issue. Clubs agreed to that almost a
century ago. They conferred on the Commissioner certain
management decisions that bind the assiciation members.
Government has the power to incarcerate folks as a punishment.
That is a very special form of punishment and that's why there
are special protections and rules. That power is very different
than that of a private association like MLB to govern itself and
formulate rules of conduct. Whatever MLB does, it's not another
layer of "punishment" but a wholly different animal. MLB can't
put anybody in jail. So, whatever they do or don't do, the state
legal process is only relevant to the extent MLB deems it
       relevant.
Guessing the Commissioner will not get involved pre-draft here.
Maybe the issue will be moot if nobody drafts/signs the kid.
But, if signed, there will be some kind of MLB review.
If he's rehabilitated and remorseful, guessing MLB won't ban
him. But, it will get a close look--if he signs.

I didn't make myself clear. Certainly, the MLB has the
authority to punish a person for mere allegations. What I was
saying was that no one SHOULD have the legal right, and
certainly not the moral right, to punish someone over mere
allegations of illegal activity. Specifically, neither the MLB
nor the team should suspend, fire or fine someone for illegal
activity if the legal authorities do not have the evidence or
       the will to prosecute.

Yes, drafting a guy you intend to try and keep in the
organization for a decade and bringing in a hired gun for two
months is exactly the same thing.

That's what purple is for, because there was no obvious reason
to believe your OP wasn't a serious opinion.
