Me 163 rules

I don’t now if anyone saw the brief exchange on CSW, but a play
of the Rocket Men by Brian Workman raised some issues with the
Me 163 rules. Specifically:
- How does a flight behave when it has a Vector but is out of
fuel?
- How does a flight behave when it is out of fuel and is in a
dogfight?
Thee’s a whole mess of nastiness inherent in the answer to these
questions. I propose making the following changes to the me 163
rules.
(a) Forbid dogfights with Me 163 flights, just as we forbid them
with bombers
(b) We say that a flight without fuel and with no tally must
return to base.
Any thoughts?

Both look fine, though in the case of B if the 163 has a tally
at a higher altitude it would seem to make sense for the 163 to
return to base as well?

I don't want to legislate on situations where a flight has a
tally and is out of puff. In some configurations they may be
able to attack, while in others they can't. I leave it to the
player to decide what to do.

According to 13.8.2, an Me 163 that's out of fuel must select no
throttle, and in that case it must dive at least one level per
turn. So if its vector is currently at its altitude or higher,
it will never be able to fly toward it. If the vector is lower,
it can fly toward it in the sense of Shortest Route and may or
may not be able to get into that square. If it does arrive at
its vector, it will have to leave that square the next turn
because of the dive requirement. So far, so good: No need for
any additional rule.
If the Me 163 is out of fuel and has a tally, by the same
reasoning it may or may not be able to fly into its target's
square, depending on whether the target is at a lower altitude.
If it can, fine, let it attack. We might have to specify that
the dive requirement overrides the requirement in 7.2.3 to stay
in its tallied target's square if it starts the movement phase
there. So if it's scheduled to move before its tallied opponent,
too bad: it must dive away. If it's scheduled to move before the
tallied opponent and that opponent free-flies to another square
at the same or higher altitude, or stays in the square, again
too bad: the Me 163 flight must dive.
Finally, the idea of Me 163s getting into dogfights seems
ridiculous and should be forbidden. They may never opt to
dogfight, and their opponents cannot force a dogfight.
In terms of rule modifications, I think all that's necessary is
to say in 13.8.2 that the dive requirement restricts the "move
freely" and "must stay" parts of 7.2.3. Otherwise let the rules
as written take care of things. Out of fuel Me 163s will fall
out of the bomber stream pretty quickly. Enemy fighters might or
might not want to stick to them in a diving fight. You could
imagine a situation where an Me 163 unit makes its initial
attack(s), uses up its fuel, tallies a lower bomber, and attacks
it "on the glide." Or even an enemy fighter. They could still do
that even if we add a rule that out-of-fuel Me 163s must return
to base.
