Ghislaine Maxwell appears in photo with bruise under her eye
Lawyers for former Jeffrey Epstein associate Ghislaine Maxwell
on Thursday provided a photo of their client from jail with a
bruise under her eye, which they argued likely resulted from
       continuous overnight flashlight surveillance.
Defense attorney Bobbi C. Sternheim argued in a letter to the
U.S. District Court for the Southern District of New York that
Maxwell's bruise "may be related to the need for Ms. Maxwell to
shield her eyes from the lights projected into her cell
       throughout the night."
According to ABC News, Sternheim said that Maxwell was unaware
of the bruise until she "caught a reflection of her aching eye"
       in a nail clipper.
The attorney argued that the Metropolitan Detention Center
questioned Maxwell about the bruise, "threatening to place her
in the [Special Housing Unit] if she did not reveal how she got
       it."
In response, U.S. District Judge Alison Nathan asked prosecutors
in an order later Thursday to explain the use of flashlight
checks, which Maxwell's defense team argues is disturbing her
sleep and limiting her ability to prepare for trial.
The trial for Maxwell, who has pleaded not guilty to charges
related to her alleged assistance in Epstein's sex trafficking
of minors, is scheduled for a July 12 start date.
Is Ms. Maxwell being subjected to flashlight surveillance every
15 minutes at night? Or any other atypical flashlight
surveillance?" Nathan asked in the order Thursday, ABC noted.
"If so, what is the basis for doing so?"
Maxwell's lawyers have repeatedly sought to get Maxwell released
from jail ahead of her trial, though an appellate court on
Tuesday turned down the 59-year-old's appeal of three previous
       orders denying bail.
Last month, Maxwell was denied bail for a third time after
prosecutors argued she continued to pose an "extreme flight
       risk."
Maxwell appeared before a New York judge in person for the first
time last week, where she entered a not guilty plea for a
recently added charge of conspiracy to commit sex trafficking,
as well as an additional sex trafficking charge.
The close confidant and onetime girlfriend of Epstein, who
killed himself in jail while awaiting trial in August 2019, now
faces a total of eight counts in connection with allegedly
aiding him in his sex trafficking scheme.

Boy Scouts’ Bankruptcy Leaves Churches Liable for Abuse Suits
Top denominations and thousands of churches are reconsidering
whether to keep hosting scout units.
Amid the Boy Scouts of America’s complex bankruptcy case, there
is worsening friction between the BSA and the major religious
groups that help it run thousands of scout units. At issue: the
churches’ fears that an eventual settlement—while protecting the
BSA from future sex-abuse lawsuits—could leave many churches
       unprotected.
The Boy Scouts sought bankruptcy protection in February 2020 in
an effort to halt individual lawsuits and create a huge
compensation fund for thousands of men who say they were
molested as youngsters by scoutmasters or other leaders. At the
time, the national organization estimated it might face 5,000
       cases; it now faces 82,500.
In July, the BSA proposed an $850 million deal that would bar
further lawsuits against it and its local councils. The deal did
not cover the more than 40,000 organizations that have charters
with the BSA to sponsor scout units, including many churches
from major religious denominations that are now questioning
       their future involvement in scouting.
The United Methodist Church—which says up to 5,000 of its US
congregations could be affected by future lawsuits—recently
advised those churches not to extend their charters with the BSA
beyond the end of this year. The UMC said these congregations
were “disappointed and very concerned” that they weren’t
       included in the July deal.
Everett Cygal, a lawyer for Catholic churches monitoring the
case, said it is unfair that parishes now face liability “solely
as a result of misconduct by Boy Scout troop leaders who
frequently had no connection to the parish.”
“Scouting can only be delivered with help of their chartered
organizations,” Cygal told The Associated Press. “It’s
shortsighted not to be protecting the people they absolutely
need to ensure that scouting is viable in the future.”
Officials of several other denominations—including the Southern
Baptist Convention, the Evangelical Lutheran Church in America
and the Presbyterian Church (U.S.A.)—have advised their churches
to hire their own legal counsel if they fear possible sex-abuse
       litigation.
The Presbyterian Church said its national leadership can’t act
on behalf of member churches because they are separate
corporations. The leadership of the Evangelical Lutheran church
also said its congregations were on their own, legally speaking,
and must decide for themselves whether to continue any
       relationship with the BSA.
“As a result of the bankruptcy, the congregation cannot
confidently rely on the BSA, the local council, or their
insurers to defend it,” the Lutheran church warned. “The
congregation needs to make sure that it has sufficient insurance
and that its own insurance will cover them.”
The Boy Scouts, in a statement provided to the AP, said its
partnership with chartered organizations, including churches,
“has been critical to delivering the Scouting program to
millions of youth in our country for generations.” It said
negotiations with those organizations are continuing, and it
hopes to conclude the bankruptcy proceedings around the end of
       this year.
       Negotiators face a challenging situation.
According to lawyers representing different parties in the
bankruptcy case, the Boy Scouts have suggested chartered
organizations have some protection from liability for abuse
cases that occurred after 1975, due to an insurance arrangement
that took effect in 1976. The BSA has said there’s little or no
protection, however, for the many pre-1976 cases, and the best
way for organizations to gain protection for that era would be
to make a substantial financial contribution to a settlement
       fund.
The Church of Jesus Christ of Latter-day Saints took such a step
last week, agreeing to contribute $250 million to a compensation
fund in exchange for a release from further liability. The
denomination, widely known as the Mormon church, pulled its
units out of the BSA on Jan. 1, 2020, after decades as the
       biggest sponsor.
One key distinction: The Latter-day Saints have a centralized
governing structure, making possible a contribution covering its
vast former network of scout units. The remaining faith-based
charter organizations are more decentralized, complicating the
question of how contributions to the compensation fund would be
       mandated and organized.
Jeremy Ryan, a lawyer representing United Methodist churches,
said his clients believe there is some pre-1976 insurance
available to them under policies the BSA and its local councils
       held at the time.
Cygal, the lawyer representing Catholic churches, made a similar
argument but said some chartered organizations eventually may
have to make an appropriate financial contribution “to put an
end to this dispute once and for all.”
Another complication in the negotiations: differing views on how
much blame lies with the churches.
Some of the churches argue that they merely provided a venue for
a local scout unit to meet, while scout leaders were responsible
for hiring decisions that might have led to sexual abuse. Some
lawyers for the plaintiffs disagree, saying church leaders were
often actively involved in those decisions.
“The Scouts had plenty of fault due to their negligence, but the
local institutions had plenty of fault also,” said Christopher
Hurley, whose Chicago law firm says it represents about 4,000
men who filed claims in the bankruptcy.
“It’s just not OK to pass the buck on this,” Hurley added.
“Everybody’s got to suck it up and make a fair contribution to
       get justice for these guys.”
Richard J. Mathews—an attorney who advised the Boy Scouts for 11
years, including in the midst of its abuse crisis—has spoken out
for years about the importance of churches adopting vigorous
prevention protocols and insuring themselves against child
       sexual abuse cases.
Mathews told Church, Law, and Tax in 2017 that he thinks
churches “don’t recognize the danger and how widespread the
problem is. We all think it’s never going to happen to us.”
But churches can be particularly susceptible. Predators often
seek out trusting environments where their behavior may be
overlooked. And courts end up finding churches liable for not
adequately screening or monitoring those working with children.
“Because victims of child sexual abuse generally allege that the
organization (church) is responsible for their injuries on the
basis of negligent selection, retention, or supervision of the
perpetrator, many such cases have been lost due to the failure
to implement appropriate safeguards in the selection and
supervision of employees and volunteers who work with children,”
       Matthews said.
“This even applies to other children volunteers (e.g., youth
       staff). Therefore, screening, background investigations,
reference checks, and interviews before the individual’s
       involvement are essential.”
Stephen Crew, whose Oregon-based law firm represents about 400
plaintiffs, said he sympathizes with faith-based chartered
organizations who “worry about being hung out to dry.”
“But survivors also have a lot of anxiety,” said Crew. “And the
problem now is that the insurance companies are balking at
       everybody.”
A third lawyer for plaintiffs, California-based Paul Mones,
blamed the churches’ predicament on the BSA, saying its initial
bankruptcy strategy failed to properly anticipate the impact on
       chartered organizations.
“For decades, the religious organizations have been the backbone
of the BSA,” Mones said. “They did not sign up thinking they’d
have any kind of liability ... and all of a sudden they’re being
told, ‘You’re going to get sued.’ It’s a hot mess.”
Some church leaders, such as United Methodist Bishop Ruben Saenz
Jr., have been blunt in their dismay over the bankruptcy
       fallout.
“This is a very sad and tragic matter that has occurred within
our nation and the Church,” Saenz said in a recent letter to the
clergy he oversees in Kansas and Nebraska. He said there might
be 110 abuse claims in the bankruptcy case potentially connected
to UMC churches in his region.
Saenz said the BSA might struggle to move forward
post-bankruptcy without participation of the UMC, the biggest
       active sponsor of Scout units.
But due to BSA positions in the case that are detrimental to the
UMC, Saenz wrote, “We simply cannot currently commit to the
relationship with the BSA as we have in the past.”

Hillsong Founder to Plead Not Guilty to Abuse Coverup
Brian Houston will go to court in Sydney over alleged child
       abuse by his late father.
Hillsong Church founder Brian Houston will plead not guilty to
illegally concealing alleged child abuse by his father, his
lawyer told a court on Tuesday.
Houston did not appear at Sydney’s Downing Center Local Court
when his charge was mentioned before a registrar for the first
time. His lawyer told the court Houston would be pleading not
guilty to the charge of concealing a serious indictable offense
of another person, his late preacher father Frank Houston.
The case will next be before the court on November 23.
Police will allege that Frank Houston indecently assaulted a
       young male in 1970.
Court documents allege that Brian Houston believed his father
had committed the crime. Police will allege that the younger
Houston failed to disclose information to police that could help
secure the prosecution of his father.
Since being charged, Houston has stepped down from the board of
Hillsong, the church he founded with wife Bobbie in Sydney in
1983. Now a global empire, the church says 150,000 people in 30
countries attend its services and 50 million people sing its
       songs each week.
Houston, 64, was in the United States in August when detectives
served his Sydney lawyers with a notice for him to appear in
       court.
He said in a statement at the time he welcomed the “opportunity
       to set the record straight.”
Houston returned to Sydney last month and was released from 14
       days’ hotel quarantine last week.
An Australian government inquiry into institutional responses to
allegations of child sex abuse found in 2015 that Houston did
not tell police that his father was a child sex abuser.
The inquiry found that Houston became aware of allegations
against his father in 1999 and allowed him to retire quietly
rather report him to police. His father confessed to the abuse
before he died in 2004 at age 82.
Hillsong Church has said repeatedly that it has not been
involved in this matter, as Frank Houston never worked for the
church, and has defended Brian Houston’s response.
“Upon being told of his father’s actions, Brian Houston
confronted his father, reported the matter to the National
Executive Assemblies of God in Australia, relayed the matter to
the governing board of Sydney Christian Life Centre, and
subsequently made a public announcement to the church. Brian
sought to honor the victim’s multiple requests not to inform the
police,” the church said in a statement in July.
“As a recent development, charges have officially been filed
against Brian Houston,” the church said at the time. “We are
disappointed that Pastor Brian has been charged, and ask that he
be afforded the presumption of innocence and due process as is
his right. He has advised us that he will defend this and looks
       forward to clearing his name.”
Hillsong, known for chart-topping worship music and megachurches
across the globe, became its own denomination in 2018. Last
year, Brian Houston announced an investigation of its New York
City campus, where pastor Carl Lentz had stepped down over
       infidelity.

Ohio mayor tells ENTIRE school board to resign or 'face child
pornography charges' after teachers gave children writing prompt
to 'write a sex scene you wouldn't show your mom'
-Hudson, Ohio Mayor Craig Schubert delivered the harsh ultimatum
       on Monday
-Threatened charges against entire school board if they don't
       resign
-Parents are outraged over book of writing prompts given to kids
       aged 17
-Prompts include raunchy sexual themes such as 'an X-rated
       Disney scenario'
-'Write a sex scene you wouldn't show your mom' another prompt
       urges
-Schubert claimed that the material amounted to child
       pornography
A mayor in Ohio has threatened the city's entire school board
with criminal charges unless they resign over highly sexual
writing prompts that teachers gave to underage students.
Hudson Mayor Craig Schubert delivered the harsh ultimate during
a school board meeting on Monday, garnering loud applause from
outraged parents who also spoke out on the topic given to
       children aged 17.
At issue are the highly inappropriate writing prompts
distributed to students in the Liberal Arts II writing class at
Hudson High School, including 'Write a sex scene you wouldn't
show your mom', 'Describe your favorite part of a man's body
using only verbs' and 'Write an X-rated Disney scenario'.
'It has come to my attention that your educators are
distributing essentially what is child pornography in the
classroom,' fumed Mayor Schubert during public comments.
'I've spoken to a judge this evening and she's already confirmed
that. So I'm going to give you a simple choice: either choose to
resign from this board of education or you will be charged,' the
       mayor added.
The mayor then rose from the microphone and stormed out of the
meeting, to loud cheers and applause from parents in the
       audience.
It was unclear whether the inappropriate written material given
to schoolchildren truly violates child pornography laws as the
mayor claimed, but nevertheless parents in the district were
       outraged.
Ohio law does prohibit sending 'harmful' or obscene material to,
or sharing it with, a minor, though this statute usually refers
to sexting or sending obscene images.
The relevant statute exempts obscene material that is presented
for 'bona fide' educational purposes, leaving the legal
       questions around the controversy murky.
The offensive prompts were given to students in the book 642
Things To Write About, which contains many innocuous writing
prompts as well as some that are highly sexualized and
       inappropriate for minors.
The writing class that the book was assigned in is offered in
association with Hiram College for college credit, but is taught
at the high school, officials said.
Parent Monica Havens told the school board meeting she found out
about the inappropriate writing prompts from a friend, the Plain
       Dealer reported.
'I asked my daughter if she had been reading a book with
inappropriate stuff in it and she said yes,' said Havens, who
was formerly a public school teacher for 11 years.
'I can't even wrap my brain around as a teacher, I don't care if
it's for college credit, these are minors,' Havens said.
'When these topics are encouraged and read by adults, that is
       pedophilia,' said the outraged mother.
'This is grooming, and all of you need to be replaced,' Havens
told the school board, telling the members: 'You have dedicated
       yourself to woke social justice.'
Havens claimed that the book had been on the curriculum for six
years, accusing the board of 'sleeping on the job.'
'You have allowed the sexualization of our youth and grooming
material to be approved for classroom content,' Havens said.
'Each and every one of you should be ashamed,' she added.
A police officer from the nearby city of Stow also addressed the
board, calling for cameras to be installed in every public
       school classroom.
'Police officers wear body cameras to monitor their behavior,
and they have brief interactions with the public. You guys have
our kids all day and we don't know what's going on in the
       classrooms,' Dirker said.
Administrators at Hudson High School have already issued an
apology over the controversy, saying they were unaware of of the
inappropriate prompts and are working to collect the books.
Hudson High School Principal Brian Wilch said at Monday's
meeting: 'There are times we need to take a step back, reflect
       and get better.'
'We did not exercise our due diligence when we reviewed this
resource and we overlooked several prompts that were not
appropriate. We felt terrible. You can't unsee them,' he said.

This was happening when I was in foster care. My brother was put
into a psychiatric hospital at the request of his foster mother.
She said he was hiding food in his room. Since when is that a
reason to put a child in a psychiatric hospital? He was very
abused and given shock treatment in that hospital and was there
       a long time, years.
DCFS director held in contempt following WGN Investigates report
       on long hospitalizations
CHICAGO - DCFS director Marc Smith has been held in contempt
following a WGN Investigates report that showed hundreds of
children were in psychiatric hospitals longer than necessary due
to the organization not having anywhere else to house them.
WGN reported in 2021 that 356 children statewide were
hospitalized beyond the time it was medically necessary, with
the average stay 55 days longer than the doctor recommendation.
Of the children hospitalized, 18 percent were under the age of
       10.
Now, Cook County judge Patrick Murphy is holding DCFS director
Marc Smith in contempt of court for his agency’s failure to find
       appropriate placements for cases.
Beginning Wednesday, DCFS will be fined $1,000 a day, every day
until the DCFS complies with the judge’s order.
